Terms and Conditions of Sale

 

L’institut de la facette is a dental training center specializing in ceramic veneers, located at 51 bis Rue Saint Sébastien, 13006 Marseille. It offers veneer training courses to dental practitioners from around the world.

Several training options are available:

1) Registration Procedure:

1.1 Registration requests must be made online at www.linstitutdelafacette.com, The completed form submitted through L’institut de la facette website is automatically sent to the institute’s email address.

1.2 For each training course offered by L’institut de la facette, a minimum and maximum number of participants is set. Registrations for a given session are closed once the maximum number of participants has been reached.

1.3 An acknowledgment of receipt is sent to the participant within 48 hours following the registration submission. This acknowledgment does not constitute confirmation that the training session will take place; only the confirmation email including the program, sent at least ten (10) days before the training date, serves as official confirmation of the session.

2) Training Terms and Conditions:

2.1 L’institut de la facette is free to use the teaching methods and educational tools of its choice. It is hereby stated that the form and content of these pedagogical tools are determined solely by L’institut de la facette.

2.2 The total duration of a training course may vary from one program to another. Therefore, participants are required to check the specific details on L’institut de la facette’s website before registering. www.linstitutdelafacette.com.

2.3 One (1) day of in-person training corresponds to seven (7) hours of instruction.

2.4 L’institut de la facette will send the training program to the participant one month before the start date.

3) FINANCIAL TERMS AND FUNDING BY THIRD-PARTY ORGANIZATIONS

3.1 Financial Terms

3.1.1 The training course prices are indicated in euros, including all taxes (VAT included). The current training fees are listed on the website. www.linstitutdelafacette.com.

3.1.2 The price of online training courses does not include the cost of the internet connection, which remains the responsibility of the participant.

3.1.5 Invoices are issued upon receipt and full payment, which may be made by cheque, bank transfer, or credit card via the website. www.linstitutdelafacette.com.

3.1.6 The training fee must be paid before the start of the course. If payment is made by cheque, the final cheque must be cashed no later than one month before the beginning of the training.

3.1.7 In the event of late payment, L’institut de la facette reserves the right to refuse any new order and to suspend the performance of its obligations until the account has been settled in full, without incurring any liability or entitling the Client to a credit note or refund. The limitation period for the recovery of any amount owed to L’institut de la facette starts from the date the corresponding invoice is issued.

3.1.8 Third-Party Funding Arrangements

3.1.9 L’institut de la facette has no partnership with organizations such as OPCO or similar institutions.

4) Cancellation

4.1 Cancellation by the Company:

L’institut de la facette reserves the right to cancel any training course no later than one month before the scheduled date if the minimum number of participants has not been reached. Each participant with a confirmed registration will be systematically contacted by phone or email one month prior to the training date by L’institut de la facette, who will confirm or cancel the session accordingly.

*Registration becomes effective upon receipt of payment.

4.2 Cancellation by the Participant:
In accordance with Article L.6353-5 of the French Labour Code, the participant has a period of ten (10) days from the date of signing the registration form submitted via L’institut de la facette website to withdraw by registered letter with acknowledgment of receipt. No refund will be issued for any cancellation made within six (6) weeks prior to the start of the training.

5) INTELLECTUAL PROPERTY

5.1 L’institut de la facette may provide participants with training materials in paper and/or digital format summarizing the key content of the course attended. This documentation may be sent by email to the address provided by the participant, distributed during the training session, and/or made available in a dedicated online space.

5.2 This documentation may not, in any form or by any means, be reproduced, represented, loaned, exchanged, transferred, or subjected to full or partial data extraction, nor may it be modified, adapted, arranged, or transformed, even in part, without the prior and express authorization of L’institut de la facette.

Only a personal right of use is granted to the participant, excluding any transfer of ownership rights of any kind. In this regard, the participant is strictly prohibited from exploiting, directly or indirectly, the documentation provided, particularly for commercial purposes.

6). INFORMATION AND COMPLAINTS

Any clarification regarding these Terms and Conditions of Sale, as well as any request for information and/or complaint, must be sent by mail to L’institut de la facette, 51 bis Rue Saint Sébastien, 13006 Marseille, or by email to facette@linstitutdelafacette.com. The institute will make every effort to respond to all inquiries as promptly as possible.

7) LIABILITY

L’institut de la facette confirms that the training courses presented on the website comply with their respective descriptions. As part of its training services, L’institut de la facette undertakes to make its best efforts to offer a program that closely meets the specific needs expressed by the participant.

It shall be the responsibility of the participant to provide proof of any alleged non-conformity.

7.2 The participant, in their capacity as a professional, is solely responsible for the consultation and selection of the training provided by L’institut de la facette.

7.3 L’institut de la facette’s liability may only be incurred in the event of proven fault or negligence and shall be limited to direct damages suffered by the participant, to the exclusion of any indirect damages of any kind, including, but not limited to, loss of opportunity, clientele, profit, business, commercial loss, or loss of data and/or files.

In any event, should L’institut de la facette be held liable, the total amount charged to L’institut de la facette shall not exceed the total price paid by the participant for the training concerned.

8 ) PERSONAL DATA

8.1 L’institut de la facette takes the privacy and protection of its participants’ personal data very seriously and undertakes to implement appropriate measures to ensure the protection of such personal data (hereinafter the ‘Data’). It further undertakes to process and use this Data in compliance with the applicable provisions, including in particular Regulation (EU) 2016/679 of 27 April 2016 (the General Data Protection Regulation – GDPR) and the amended French Data Protection Act No. 78-17 of 6 January 1978 (hereinafter the ‘Applicable Provisions’).

8.2 The Data is processed electronically by L’institut de la facette, acting as the data controller, for the purposes defined in the Privacy and Personal Data Processing Policy, available on our website (hereinafter referred to as the ‘Privacy Policy’)

The Data is retained for the period strictly necessary to achieve the purposes set out in the Privacy Policy.

For the sole purpose of managing business relationships, this Data may be shared with our partners in accordance with the Privacy Policy.

Any individual has the right to access, rectify, erase, and transfer their Data, as well as to restrict or object to its processing, and to determine the disposition of their Data after their death. These rights may be exercised in accordance with the procedures set out in the Privacy Policy.

In the event that the right to object is exercised, all communications with the participant (except for account management) shall cease.

8.3 If the participant transmits and/or integrates Data necessary for the provision of a training course, the participant shall be considered the data controller.

In its capacity as a data processor, L’institut de la facette undertakes to process the Data in accordance with the participant’s documented instructions and solely for the purpose of providing the training. If L’institut de la facette considers that an instruction constitutes a breach of the applicable data protection provisions, it shall immediately inform the client. By way of exception, if L’institut de la facette is required to process the participant’s Data under applicable laws or regulations, it shall inform the participant of this legal obligation prior to the processing, unless the relevant law prohibits such notification. L’institut de la facette guarantees the confidentiality of the Data processed in the context of the training. It undertakes to ensure that any persons authorized to process the Data receive appropriate training in personal data protection and are bound by a confidentiality agreement or a suitable statutory obligation of confidentiality. L’institut de la facette further undertakes to apply the principles of data protection by design and by default in connection with its tools, products, applications, and services. It also commits to implementing appropriate technical and organizational measures to protect the integrity and confidentiality of the stored Data. L’institut de la facette shall provide sufficient guarantees to ensure the implementation of appropriate security and confidentiality measures, taking into account the nature of the Data and the risks inherent in the processing.

L’institut de la facette shall make available to the participant all documentation necessary to demonstrate compliance with its obligations and to enable audits, including inspections, to be carried out by the participant or by another auditor appointed by the participant, and shall cooperate in the conduct of such audits. In the event that the participant is required to disclose Data to a third party and/or to an administrative or judicial authority, L’institut de la facette shall cooperate with the participant to provide the required information in accordance with these Terms and the applicable regulations. L’institut de la facette shall notify the participant of any Data breach as soon as it becomes aware of it. The name and contact details of L’institut de la facette’s Data Protection Officer (DPO) are provided in the Privacy Policy.

L’institut de la facette informs the participant that all Data is hosted within the European Economic Area. In the event of subcontracting, L’institut de la facette undertakes to enter into a written agreement with the subcontractor requiring compliance with the applicable data protection provisions and all obligations set forth in this article. It is expressly understood that, in the event of any failure by a subcontractor to comply with its personal data protection obligations, L’institut de la facette shall remain fully liable to the participant.

Any person whose Data has been collected by the participant has the right to access, rectify, erase, and transfer their Data, as well as to restrict or object to its processing, and to determine the disposition of their Data after death, by contacting the participant directly. The participant guarantees to L’institut de la facette that they have fulfilled all obligations required under the applicable provisions and have informed the individuals concerned of how their Data is used. In this respect, the participant shall indemnify and hold L’institut de la facette harmless from any claim, complaint, or action brought by any individual whose Data is processed. Furthermore, the participant undertakes to document in writing any instructions concerning data processing by the Training Organization, to ensure, both prior to and throughout the duration of the training, that L’institut de la facette complies with the applicable data protection obligations, and to supervise such processing, including by conducting audits and inspections of L’institut de la facette. Data shall be retained only for as long as necessary to achieve the purpose for which it was collected. Upon completion of the training, L’institut de la facette undertakes, at the participant’s choice, to either destroy or return the Data and to provide written confirmation to the participant that no copies have been retained.

9) GENERAL PROVISIONS

9.1 The Terms and Conditions of Sale are available online and may be modified at any time at the discretion of L’institut de la facette, without any formality other than their publication online. Only the latest version shall apply.

9.2 If any provision of these Terms and Conditions is declared null and void, it shall be deemed unwritten but shall not result in the invalidity of the training agreement.

9.3 The participant undertakes to treat as strictly confidential, and not to disclose, any information, document, data, or concept that they may become aware of in the course of the training.

9.4 L’institut de la facette is authorized to subcontract all or part of the services covered by these Terms and Conditions. All obligations of the participant arising under these Terms and Conditions shall apply solely to L’institut de la facette, which remains fully responsible to the participant.

9.5 The failure to invoke or enforce any provision of these Terms and Conditions, whether permanently or temporarily, shall not be construed as a waiver of such right.

9.6 L’institut de la facette is authorized to use the corporate name, trade name, and/or trademarks of the participant, and where applicable, of the group to which the participant belongs, as a business reference on any medium or occasion for marketing and/or advertising purposes, without the participant’s prior authorization.

9.7 The Parties shall conduct and continue to conduct their activities independently in the performance of this agreement, which shall not be interpreted, in particular, as creating any relationship of subordination or a de facto partnership between them.

9.8 The participant waives the benefit of Articles 1221, 1222, and 1223 of the French Civil Code.

9.9 The participant may not bring any action, regardless of its nature or basis, more than one year after the event giving rise to the claim.

9.10 These Terms and Conditions of Sale are governed by French law. Any dispute relating to their performance or interpretation shall fall under the exclusive jurisdiction of the Paris Commercial Court, even in the event of summary proceedings, third-party claims, or multiple defendants.
